What to do After the Loss of a Loved One?

Losing a loved one is an incredibly difficult experience, and navigating the necessary steps that follow can be overwhelming.

Determine if There is a Will or Trust: The first step is to find out whether the deceased left a will and/or a trust.

Notify the Personal Representative: If there is only a will, you need to inform the Personal Representative named in the document.

Contact the Trustee: In cases where there is a trust, get in touch with the trustee immediately.

What if You are a Beneficiary?

As a beneficiary, you have rights that are protected by law, ensuring that your interests are upheld during the probate process. However, navigating familial dynamics can be complex. With multiple marriages, sibling rivalries, and other family dysfunctions, disputes over trusts and estates can often arise. These conflicts can sometimes seem like the plot of a daytime soap opera, complete with unexpected twists and turns. Situations where families discover deception or unforeseen circumstances often lead to probate litigation. It's not uncommon for family drama to continue even after a loved one's passing, resulting in legal battles over inheritance.

What if Something Goes Wrong?

Disputes in probate can emerge due to deceit, greed, or miscommunication. Typically, probate litigation occurs when an interested party believes there was wrongdoing during the probate process or prior to a loved one's death. Trusts or wills may not function as intended for various reasons. For instance, the document may have been created by someone lacking mental capacity, or there may have been coercion or undue influence involved. These issues can complicate the execution of a will or trust, leading to legal challenges that need resolution.

What Should You Do with Your Loved One’s Digital Accounts?

As we step further into the digital age, managing online assets after one's passing is crucial. At Rilus Law, we've been creating Digital Asset Trusts since Arizona's legal framework allowed it in 2016. If your loved one has a Rilus Law or Dana and Associates, LLC estate plan, check for a Digital Asset Trust with specific instructions for their digital accounts. Below are some basic steps, but for more details, enter your email above to download our Death of a Loved One Checklist with a Digital Account Guide.
